In most cases, the entire Chapter 7 bankruptcy process consists of completing the official bankruptcy forms, filing them with the US Bankruptcy Court, and attending a 3 to 5-minute meeting with a bankruptcy trustee. Creditors rarely attend the meeting, and no attorney or court hearing is required in most cases. I'll briefly go through each official form that's required to file Chapter 7 bankruptcy. You can hire an attorney to fill these forms in for you, or you can fill them in yourself. The first form is the voluntary petition. The first thing you do is select from this drop-down menu the court district you're filing in. It includes all the court districts for the entire country. In this example, I'm using the Quick File automated bankruptcy form software, which is used by every Bankruptcy Court in the country. Next, you will enter the case number. If you haven't filed for bankruptcy yet, you leave it blank. Then, you select the chapter under which you're filing, usually either Chapter 7 or Chapter 13. In this example, I've selected Chapter 7. The form will then ask for basic information about yourself, such as your name and any other names you've used in the last eight years. You'll also provide the last four digits of your Social Security number or any federal identical taxpayer identification numbers you've used. If you've used any business names or employer ID numbers in the last eight years, you'll provide that information as well. You'll need to provide your current physical address and an optional mailing address if you don't receive mail at your home address.
