Installment agreements, also known as payment plans, are a way for individuals to manage their tax liabilities. The IRS has specific rules and conditions for installment agreements. If a taxpayer enters into a formal installment agreement, the IRS is prohibited from taking adverse collection action against them. However, the IRS may file a federal tax lien if the taxpayer owes more than $5,000. There are several types of installment agreements available. The first is a guaranteed installment agreement, which applies to taxpayers who owe less than $10,000 and can fully pay their liability within three years. This type of agreement is guaranteed by the IRS, and the taxpayer can contact the IRS to set it up. Conditions and details may apply, but the bottom line is that if you owe $10,000 or less and can pay it off in three years, the IRS will likely grant you an installment agreement. The second type is a streamlined installment agreement, which is applicable for taxpayers who owe less than $25,000 and can pay it off within 60 months. For this type of agreement, the IRS does not require extensive financial documentation. As with the guaranteed installment agreement, the taxpayer must demonstrate their inability to pay the full liability at present. The third type, which I have named a complex installment agreement, applies when the liability exceeds $25,000 and cannot be paid off within five years. In such cases, the IRS conducts a financial analysis to determine the taxpayer's ability to pay. The fourth and final type is a partial pay installment agreement. This type of agreement is for taxpayers who are unable to fully pay their liability during the collection statute of limitations.
